1. Agreement to Terms

By accessing or using the Guest Card mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and LocatorHub ("we," "our," or "us").

2. Description of Service

Guest Card is a mobile application designed for property managers, leasing agents, and real estate professionals to:

  • Create professional guest cards with property and occupant information
  • Generate PDF documents with custom branding
  • Send guest cards via email (Apple Mail, Gmail, or other email applications)
  • Store frequently used locations and emails in an address book
  • Customize guest cards with logos and profile photos

3. Subscription Terms

3.1 Subscription Plans

Guest Card Pro is offered as an auto-renewable subscription:

  • Monthly Subscription: $4.99 per month
  • Free Trial: 7-day free trial for new subscribers

3.2 Free Trial

New subscribers are eligible for a 7-day free trial. During the free trial period:

  • You have access to all Guest Card Pro features
  • No charges will be made during the trial period
  • You can cancel anytime during the trial without being charged
  • If you do not cancel before the trial ends, you will be automatically charged $4.99 for the first month

3.3 Auto-Renewal

Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours prior to the end of the current period.

3.4 Payment

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions are billed monthly
  • Prices are in U.S. dollars and may vary in other countries
  • Prices are subject to change with advance notice

3.5 Managing Subscriptions

You can manage your subscription and turn off auto-renewal by:

  1. Opening the Settings app on your iOS device
  2. Tapping your Apple ID at the top
  3. Tapping "Subscriptions"
  4. Selecting "Guest Card Pro"
  5. Tapping "Cancel Subscription"

3.6 Cancellation

  • You can cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You will continue to have access to Pro features until the end of the current period
  • No partial refunds for unused portions of a subscription period

3.7 Refund Policy

All sales are final. Refunds are handled by Apple according to their refund policy. To request a refund:

  1. Visit reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Find the Guest Card subscription
  4. Select "Report a Problem"

Refund requests are subject to Apple's approval and policies.

4. User Accounts and Registration

You may optionally sign in with your Google account to use Gmail sending features. By signing in:

  • You authorize us to access your Google profile information (name, email, photo)
  • If you grant Gmail permissions, you authorize us to send emails on your behalf
  • You can revoke access at any time through your Google Account settings
  • Google Sign-In is optional; you can use the App without it

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Send spam or unsolicited emails through the App
  • Violate any laws regarding export of data or software
  • Infringe on intellectual property rights of others
  • Attempt to gain unauthorized access to the App or related systems
  • Use the App to transmit viruses or malicious code
  • Reverse engineer, decompile, or disassemble the App
  • Remove or modify any copyright, trademark, or proprietary notices

6. Intellectual Property

The App and its original content, features, and functionality are owned by LocatorHub and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission.

7. User Content

7.1 Your Content

You retain all rights to the content you create using the App, including:

  • Guest card information (names, contact details, property information)
  • Generated PDF documents
  • Uploaded logos and photos

7.2 Storage and Responsibility

  • All content is stored locally on your device
  • You are responsible for backing up your own content
  • We are not responsible for any loss or corruption of your content
  • We do not have access to your content

7.3 Content Accuracy

You are solely responsible for ensuring the accuracy and legality of information you include in guest cards. This includes:

  • Verifying occupant information
  • Ensuring property information is accurate
  • Complying with fair housing laws
  • Obtaining necessary consents for personal information

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability

WE DO NOT WARRANT THAT:

  • The App will meet your requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Results obtained from the App will be accurate or reliable
  • Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCATORHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, use, or goodwill
  • Service interruption
  • Computer damage or system failure
  • Cost of substitute services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM (NOT TO EXCEED $59.88).

10. Indemnification

You agree to indemnify, defend, and hold harmless LocatorHub and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you create or share using the App

11. Third-Party Services

The App integrates with third-party services:

We are not responsible for third-party services or their terms, policies, or practices.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Requests by law enforcement or government agencies

Upon termination:

  • Your right to use the App will cease immediately
  • Your subscription will be canceled (subject to refund policy)
  • You may delete the App and all associated data from your device

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@locatorhub.app.

14.2 Arbitration

Any dispute arising from these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

14.3 Class Action Waiver

You agree that disputes will be resolved individually, and you waive the right to participate in class actions or class-wide arbitrations.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

  • Posting the new Terms on this page
  • Updating the "Last updated" date
  • Sending a notification through the App (for material changes)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LocatorHub regarding the App and supersede all prior agreements and understandings.

19. Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge that:

  • These Terms are between you and LocatorHub, not Apple
  • Apple has no obligation to provide support for the App
  • Apple is not responsible for addressing any claims relating to the App
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms
  • You must comply with all applicable third-party terms when using the App

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
